The prosecutor's office is funded by the taxpayers and has a limited budget. Public safety should be top priority when deciding which cases to prosecute. Crimes against our citizens and their property must take priority over victimless crimes.
The current prosecutor's policy is to under-charge crimes and offer plea agreements. If the accused does not agree to the plea, they are often threatened and charged with additional and higher crimes. This type of charging is unfair to the accused and the victims. Plea agreements are an essential part of the judicial process, but should not be used in lieu of trying "tough" cases or to fully prosecute repeat offenders.
I would emphasize deferred prosecution over deferred sentencing for non-violent crimes. Under deferred prosecution, if the accused "stays clean" they avoid a criminal record. With deferred sentencing, a person avoids serving any time but a "criminal conviction" follows that person for the rest of their lives.
